Is the Government of Canada required to file a proof of claim with trustees/receivers for the purpose of recovering WEPP payments from the estate or property?
The provisions of Section 36 of the
Wage Earner Protection Program Act stipulate that an applicant subrogates his or her right, in respect to the amount of a
WEPP payment for unpaid eligible wages, to her Majesty in right of Canada. As such, only the applicant (
i.e. the worker) is required to file a proof of claim with the trustees/receivers.
