Before you apply, you should have received a copy of the information provided to Service Canada by the trustee or receiver appointed in your employer's bankruptcy/receivership. This information, in combination with your application, will be used to determine your eligibility and payment. In some cases, supplementary forms may also be required.
Service Canada cannot process your application unless the trustee/receiver information has also been received. If you disagree with the amounts the trustee or receiver has indicated is owing to you, please discuss this with them before applying.
Please follow these instructions:
- Submit a proof of claim to the trustee/receiver in order to receive a WEPP payment. A proof of claim is a written statement filed during bankruptcy or receivership proceedings in which a creditor cites the reason a debtor owes the creditor money.
- If you have not already filed a proof of claim, the trustee/receiver appointed in your former employer's bankruptcy/receivership will assist you in filing a proof of claim. You may also be entitled to compensation beyond what can be paid under the WEPP.
- Applications must be submitted to Service Canada within 56 days of either the later of:
- the date of bankruptcy/receivership;
- the date that your employment ended due to termination, resignation, retirement or expiry of term; or
- the date on which the receiver terminated your employment.
If there is good cause for missing this deadline, a written explanation for the delay must be provided.
Supplementary Forms
In addition to the application form:
- If, during the period for which wages are owed, you were related by blood, marriage (including common-law) or adoption to a person with a controlling interest in the business, an officer, a director or a manager, you need to complete and print this form.
- If you wish to appoint a representative to apply on your behalf, please complete and print this form.
- If you are medically incapacitated and wish to appoint a representative to apply on your behalf, please complete and print this form.
- If the applicant is deceased and you are the beneficiary of the applicant's estate and wish to apply, please complete and print this form.
