4.0 Co-Management Arrangements
Management Committee
4.1 The Labour Market Partners agree to establish a joint committee to be called the Management Committee to oversee the effective administration and implementation of this Agreement.
4.2 The Management Committee will be composed of an equal number of representatives of each Labour Market Partner. It will be co-chaired by the Regional Executive Head of HRDC, Newfoundland Region and the Deputy
Minister of Human Resources and Employment. A representative from each of the Department of Development and Rural Renewal and the Department of Education will be members of the Committee. Other members may be appointed by each co-chair, as appropriate, but in numbers to ensure equal representation from each level of government. The Committee shall meet on a needs basis but at least quarterly.
4.3 Decisions of the Management Committee will be by consensus. If consensus cannot be reached, then the issue(s) will be referred to the signatory Ministers of the Labour Market Partners for resolution.
4.4 The Management Committee has the following powers, duties and functions:
a. to establish all procedures in respect of its own meetings, including rules for conduct of meetings, the appointment of alternates for members and the making of decisions where the members are not physically present in one place;
b. to establish Regional Committees for Labour Market Development and other committees as may be required from time to time, and make provision for administrative support for all committees from the resources referred to in Section 13.9, as appropriate;
c. to identify and implement, in accordance with the Act, any changes that may be required from time to time to the employment benefits and support measures and in the operation of the National Employment Service in Newfoundland and Labrador, and to design and recommend any new employment benefits that may be required, for approval by the Commission;
d.to establish annual funding allocations for each employment benefit and support measure;
e.to require and approve, prior to the start of each fiscal year, an annual business plan from each Regional Committee for Labour Market Development based on program and financial parameters established by the Management Committee, and establish annual funding allocations for each Regional Committee for Labour Market Development;
f.to delegate to and authorize all committees established under this agreement to perform such tasks as the Management Committee deems appropriate;
g.to set annual result targets related to the accountability framework referred to in section 9, and to monitor and evaluate the results of program delivery in relation to these targets;
h.to authorize the re-alignment of Regional Committees for Labour Market Development funding allocations, if and as necessary, during each fiscal year;
i.to authorize the approval of pan-provincial and special initiatives that are not restricted to one particular Regional Committee for Labour Market Development, and retain an annual funding allocation during each fiscal year for such purposes;
j.to ensure the implementation of the information sharing and evaluation provisions of this Agreement;
k.to ensure that the labour market development needs and priorities in Newfoundland and Labrador are coordinated and fulfilled;
l.to carry out the powers, duties, and functions specified elsewhere in this Agreement or such additional powers, duties and functions as may be assigned to it by the Labour Market Partners to accomplish the objectives of the Agreement;
m.to make available to government departments the results obtained under this Agreement to assist them in identifying labour market, social and economic development opportunities and issues;
n.where necessary to ensure efficient and effective implementation, to coordinate the activities under this Agreement with those of other federal and provincial departments and agencies; and
o.to resolve issues that might be stalemated at the Regional Committee for Labour Market Development and other committee levels.
4.5 Canada remains responsible for ensuring the integrity of the Act.
Regional Committees for Labour Market Development
4.6 The Regional Committees for Labour Market Development established by the Management Committee under paragraph 4.4(b) shall be co-chaired by the appropriate District Director of HRDC and a representative of the Department of Human Resources and Employment. Other members will be as appointed by the Department of Development and Rural Renewal (1 member on each) and the Department of Education (1 member on each) and HRDC to ensure equal representation from both levels of government.
4.7 Decisions of the Regional Committees for Labour Market Development, will be by consensus. In the event of non-consensus, issues will be referred to the Management Committee for resolution.
4.8 The Management Committee will establish the responsibilities and authorities of Regional Committees for Labour Market Development.
