PART V

ADMINISTRATIVE PROVISIONS

Decision of the Umpire

87.  (1) A decision of an umpire shall be given in writing and a copy of the decision shall be sent to

(a) the appellant;

(b) the Commission;

(c) any person or association having a direct interest in the decision; and

(d) such other persons or associations as the umpire may direct.

     (2)  Where, in respect of a claim for benefits, an application is made by the Commission under the Federal Courts Act for judicial review of the decision of the umpire, benefits are not payable in respect of that claim until the final determination of the claim.

     (3)  Where, in respect of a claim for benefits, an umpire has declared a provision of the Act or these Regulations to be ultra vires and an application is made by the Commission under the Federal Courts Act for judicial review of the decision of the umpire, benefits are not payable in respect of any other claim for benefits made after the decision of the umpire until the final determination of the claim under review, where the benefits would not otherwise be payable in respect of any such subsequent claim if the provision had not been declared ultra vires.
