Misconduct is a question of law and fact that must be resolved by means of answering specific questions based on the unprejudiced evaluation of the information gathered from different sources: 

Question 1 

Does the information in the file support the finding that the claimant committedactions or omissions as defined by the interpretation given to the word "misconduct"? 

Question 2 

Does the information in the file support the finding that the claimant lost his or her employment because of theseactions or omissions?
